90-Day "You Can't Lose" Guarantee — Terms & Conditions

These Terms and Conditions ("Terms") govern the Time To Build Membership 90-Day "You Can't Lose" Guarantee (the "Guarantee") conducted by Noske Creative Pty Ltd ("Noske Creative", "we", "our", or "us"), ABN 40 678 027 051, in connection with the Time To Build Membership ("Membership"). By participating in the Guarantee, you agree to be bound by these Terms.
1. Our Commitment to You
We are confident in what we teach inside Time To Build. We believe that if you show up, do the work, implement the strategies, and run a Lean Launch™, you will recoup your investment, and likely exceed it.
To honour that commitment, we offer a Conditional Full Refund Guarantee for action-takers who are ready to implement. This is not a change-of-mind policy.
2. Eligibility: How to Activate the Guarantee
A. Who the Guarantee is for
You are eligible to activate the Guarantee if you:
- join the Time To Build Membership as a new paid member (monthly or annual), and
- remain in good standing during the Guarantee Period (for example, payments are successfully processed, no chargebacks, no payment disputes).
3. The Guarantee: "Do The Work" Requirements
If you complete the requirements below, run a Lean Launch™, and do not achieve the Results Threshold (defined in Section 3C) within the Guarantee Period, Noske Creative Pty Ltd will refund the Membership fees you paid during the Guarantee Period, subject to these Terms.
3A. Participation and involvement
- Minimum attendance: You must attend at least 50% of live calls made available to members during your Guarantee Period (live attendance or replay completion is acceptable, provided you can evidence completion).
- Engagement: You must demonstrate active engagement through a reasonable pattern of participation (for example, asking questions, contributing to discussions, completing activities, or engaging in the community).
- No silent struggles: You must show you utilised available support when needed, including asking questions during Q&A, posting in the community, or using the official support channels.
3B. Execution and implementation
- Evidence of implementation: You must provide evidence of consistent application of Time To Build frameworks, tasks, and strategies during your Guarantee Period.
- Submission: Proof of implementation (for example, screenshots, documents, links, recordings, drafts, landing pages, offer pages, email sequences, content outputs) must be provided either:
- upon our request during your Guarantee Period, or
- voluntarily through the Membership's designated submission channels (for example, "Ask Tom", weekly check-ins, or support threads).
3C. Results and improvement (refund trigger)
The Guarantee Period
The "Guarantee Period" is 90 days from your date of joining as a paid member.
Lean Launch requirement
To be eligible for a refund, you must run a Lean Launch™ during the Guarantee Period. A Lean Launch includes, at minimum:
- a workshop,
- a live sales mechanism (for example, landing page, workshop registration page, checkout link, payment link), and
- outbound and inbound selling activity (for example, launch emails, posts, DMs, calls, or lead nurturing that directly supports the launch).
Results Threshold
If, after meeting the criteria in Sections 3A & 3B, you:
- run a Lean Launch within the Guarantee Period, and
- do not generate at least $2,000 USD in gross revenue collected from that launch within the Guarantee Period,
then you are eligible to request a refund under this Guarantee.
Notes:
- "Gross revenue collected" means money actually received (not "potential revenue", and not "verbal commitments").
- If your Membership fees paid during the Guarantee Period exceed $2,000 USD (rare, but possible depending on plan and timing), the threshold becomes "your total Membership fees paid during the Guarantee Period".
- The refund covers Membership fees paid during the Guarantee Period only. It does not cover external tools, contractors, ads, payment processor fees, taxes, or any other costs you choose to incur.
4. How to Request a Refund
A. Submit your request
Submit your refund request by email to admin@timetobuild.live.
B. Timing window
Your request must be submitted between Day 91 and Day 105 from your date of joining as a paid member.
C. Include evidence
Your email must include:
- a short written summary of what you implemented,
- proof you ran a Lean Launch (for example, sales page live, emails sent, checkout links, invoices, launch calendar, campaign posts, webinar, DMs, sales activity),
- evidence for Sections 3A and 3B, and
- evidence you did not generate at least $2,000 USD in gross revenue collected from the Lean Launch during the Guarantee Period (for example, Stripe screenshots, invoices, revenue summary, payment confirmations).
If you do not submit sufficient evidence, or if the request is outside the eligible window, the refund will not be granted.
5. Legal and Jurisdiction
Governing law
These Terms are governed by the laws of Victoria, Australia. Disputes will be handled under the jurisdiction of the Courts of Victoria.
Australian Consumer Law (ACL)
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms is intended to exclude, restrict, or modify any rights you have under the ACL. This Guarantee is an additional warranty provided by Noske Creative Pty Ltd to ensure your satisfaction and success.
Discretion
Noske Creative Pty Ltd reserves the right to determine, acting reasonably, whether the evidence submitted meets the requirements of participation and implementation, and whether the launch and revenue evidence aligns with this Guarantee.
Misuse and bad-faith conduct
We may deny a claim where there is evidence of misuse, bad faith, misleading evidence, chargebacks, payment disputes, harassment, or material breaches of community rules.
